18 U.S.C. § 2257 Exemption Statement

Vyxen (the “Platform”) is not a producer of any content found on the website. The Platform’s activities, with respect to such content, are limited to the transmission, storage, retrieval, hosting, and/or formatting of content posted directly by third-party users, and therefore the Platform qualifies for the exemption under 18 U.S.C. § 2257(h)(2)(B)(v) and 28 C.F.R. § 75.1(c)(4).

Content Provider Obligations

All content on the Platform is uploaded by third-party content providers (“Partners” and “Creators”). Each content provider is solely responsible for compliance with 18 U.S.C. § 2257 and all other applicable laws. As a condition of using the Platform, all content providers must:

• Verify that all individuals depicted in their content are at least 18 years of age at the time of production.
• Maintain all records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75, including records of the legal name, date of birth, and any aliases of every individual depicted in their content.
• Obtain and retain written consent from all persons depicted in their content, including consent to be depicted, consent to public distribution, and, where applicable, consent to downloading.
• Make such records available for inspection as required by law.

Platform Verification Measures

Although the Platform is exempt from the record-keeping requirements of 18 U.S.C. § 2257 as a non-producer, we take the safety and legality of content on our platform seriously. All content providers must complete identity and age verification before uploading content. All uploaded content is subject to review before publication to ensure compliance with our Terms of Service and applicable law.

Reporting

If you believe any content on the Platform violates 18 U.S.C. § 2257 or depicts a minor, please report it immediately using our in-app reporting tools or by contacting us at support@vyxen.net. All such reports are treated with the highest priority and will be reviewed and resolved within five (5) business days.
